AMEND BY INSERTING THE FOLLOWING PARAGRAPH AFTER LINE 1497:

(iii) An applicant for a certificate of need for the construction, expansion or conversion of nursing facility beds to be located in any county in which the 1998 State Health Plan indicates an additional bed need of less than fifty (50) beds may appeal the issue of additional bed need in such county to the State Board of Health for review. Any such appeal may be taken during the next two (2) fiscal years and the applicant will be allowed to present documentation to the State Board of Health, or a subcommittee designated for this purpose, that there is a greater nursing bed need than is indicated in the State Health Plan. If the State Board of Health rules that there is an additional bed need of fifty (50) or more beds in such county, the State Department of Health shall proceed to issue a certificate of need to the applicant according to all other applicable terms of this paragraph (gg).
